  • Anatomy of an Indemnification Provision

    A deep dive into limitation of liability clauses including discussion on limitations, judicial approaches to interpretation, common issues, and what to avoid and focus on when negotiating these clauses. Before the start of the session, please download the “Comparative Table of SC Indemnity Clauses” for easy reference.     The Model Procurement Code was first published in 1979. It was nearly 20 years later, at the request of state procurement officials, that the revised ABA 2000 Model Procurement Code was issued to reflect 20 years of changes in public procurement. Over the past 20 years, countless procurement code reform efforts have taken place. This session is designed to continue that conversation and propose procurement reform, whether as part of the Model Procurement Code or otherwise.

    • Understanding of Model Procurement Code development and adoption.
    • Discussion around current opportunities for procurement revision.
    • Identification of how states can benefit from federal code development.
